Here are some of the ways the DOJ says Apple is a monopoly. AdvertisementHere are a few ways the DOJ argues that Apple maintains a tight hold over the iPhone ecosystem — and keeps competitors out. The suit argues that Apple sets conditions for the apps it allows on the App Store and imposes anti-competitive rules and regulations. CNN —Hey, parents, leave your kids alone. There is the obvious threat of school shootings, which is surely one reason why parents may want their children to have phones on them. Several parents told me that they also strive to stay connected to their kids in emergencies, while minimizing distractions at school. Social media platforms need to do their part in restricting access to their platforms for young kids. And school leadership need to stand up, even in the face of anxious or demanding parents.

Apple's stock fell Monday morning after EU regulators slapped the company with a $2 billion fine. The fine is part of the EU's push to get Apple to open up its App Store. Investors are trying to figure out how much opening the App Store will hurt the company long term. Which means, at the moment, that Apple's $2 billion fine has cost it some $80 billion in market cap. But as recently as a month ago, the conventional wisdom was that Apple's fine was going to be something in the $500 million range.

Having a higher VO2 max is good, but more important for health is how the number changes over time. There's a way to use VO2 max to improve heart health and fitness without getting too bogged down in the data. So you have a higher VO2 max, you have a better endurance capacity," Blander said. Men tend to have a slightly higher VO2 max, so an example for an active man could be around 42 mL/kg/min. "If you have higher VO2 max you have a much better chance based on our data analysis to live better, longer, which is amazing," Blander said.

Learn moreKnowledge is power, the saying goes, so you may be tempted to use wearables to track your health data in the hopes of preventing or managing an illness or hitting certain fitness goals. Plus, it's important to take the data, which might not be entirely accurate, with a pinch of salt, Probert said. That doesn't mean the best fitness trackers aren't helpful, it just means you shouldn't take their data as gospel. Fitness trackers can't know our metabolic rates and how much muscle we have compared to body fat, which affects our energy expenditure. And, Probert cautioned, it's important not to stop listening to your body and checking in with how you feel when using such devices.

Apple is expected to begin selling its flagship smartwatches without the capability to detect people’s pulse rate. The court ordered Apple to stop selling its Apple Watch Series 9 and Watch Ultra 2 devices. Rather than discontinue sales, the company sought permission to continue selling the devices after removing the infringing technology. People with Apple watches capable of detecting their pulse will continue to be able to use that feature, analysts said. The International Trade Commission in October found that several Apple Watches had infringed on patents held by Masimo, a medical technology company in Irvine, Calif., that helped pioneer some pulse oximeter technology.

Apple Watch imports banned in America - again
  + stars: | 2024-01-17 | by ( Clare Duffy | ) edition.cnn.com   time to read: +2 min
New York CNN —A federal appeals court has denied Apple’s motion to temporarily pause a ban on imports of advanced models of the Apple Watch and the ban will be reinstated on Thursday, according to a Wednesday court filing. Apple had requested a stay on the ban while it appealed a US International Trade Commission ruling that went into effect last month. That ITC order prevented Apple from importing the Apple Watch Series 9 and Apple Watch Ultra 2, among other newer models, to the United States because they violate patents registered to another company. However, Apple will have a workaround: The company earlier this month received approval from US Customs and Border Protection to continue importing a redesigned version of the most advanced Apple watches. Apple Watch ban sagaThe import ban stems from an October ITC ruling that the pulse oximeter feature in the advanced Apple Watch models violated a patent belonging to California company Masimo.

The ruling issued Wednesday by the U.S. Court of Appeals in Washington comes three weeks after it blocked the ban. Apple is still trying to persuade the federal appeals court to overturn the ITC's ruling, but Wednesday's decision means the company is no longer insulated from the U.S. sales ban. The Cupertino, California, company also could negotiate a settlement with Masimo that would clear the way for it to continue selling the Apple Watch models with the blood-oxygen sensor. Having to pull its two top Apple Watches from the U.S. would put a small dent in the company's annual sales of $383 billion. Although the company doesn't disclose the volume of Apple Watch sales, analyst estimate the product accounts for about $18 billion in annual revenue.

Apple will remove the blood oxygen feature from its latest Apple Watches, a move that will allow the company to continue importing and selling the devices in the U.S. as it battles with Masimo in court. Modified versions of the Apple Watch Series 9 and Ultra 2 will go on sale Thursday, Apple said in a statement. "These steps include introducing a version of Apple Watch Series 9 and Apple Watch Ultra 2 in the United States without the Blood Oxygen feature. There is no impact to Apple Watch units previously purchased that include the Blood Oxygen feature." WATCH: Apple again banned from selling watches in U.S. with blood oxygen sensor

Apple smartwatches ads are displayed as customers take a look at smartwatch accessories at the Apple store in New York, U.S., December 26, 2023. Apple will again be barred from selling watches with blood oxygen sensors beginning Thursday, a federal appeals court said Wednesday. The decision is a blow to Apple, which was previously forced to remove the latest Apple Watches from its U.S. stores for several days in December. Apple may be forced to remove a blood oxygen sensor feature on its latest devices in order to keep the smartwatches on the U.S. market. If Apple must continue to keep its latest smartwatches from U.S. stores, it could complicate repairs at Apple stores, which often swap broken devices with replacements.

Apple had said that a proposed redesign would allow it to circumvent findings that the watches infringe Masimo's blood-oxygen reading pulse oximetry patents. According to Masimo's filing on Monday with the Federal Circuit, Apple told the U.S. Customs and Border Protection agency that its redesigned watches "definitively do not contain pulse oximetry functionality." Irvine, California-based Masimo has accused Apple of hiring away its employees and stealing its pulse oximetry technology to use in Apple Watches after discussing a potential collaboration. Apple has included a pulse oximeter feature in smartwatches since its Series 6 Apple Watch in 2020. Masimo asked the ITC in 2021 to bar Apple's imports and sales of Apple Watches that allegedly infringed its patents.

AdvertisementIn the past, I've argued that Apple products have become boring because Apple seems to have lost its way with useful product innovation. But the truth is, there's a very good reason why Apple doesn't do drastic changes to its products: slow, steady and reliable products are keeping Apple on top. To be fair, under CEO Tim Cook, Apple has had several big hit new products: Apple Watch and Air Pods, come to mind. While Air Pods will work with others, they are really designed to work best with Apple products. But ultimately, even if you find Apple products boring rather than classic, they are a great choice for those looking for long-lasting, high-quality, user-friendly, reliable technology.

In 2020, Masimo sued Apple in Federal District Court in California, alleging theft of trade secrets. Last year, Apple sued Masimo in federal court in Delaware, charging that Masimo was the one doing the illegal copying and was trying to knock Apple out of the market to make way for its own watch. Masimo counter-claimed that Apple had infringed its patents, falsely advertised its watches’ capabilities and violated antitrust and fair competition laws.
